Arbitration Arbitration is a form of alternative dispute resolution where the parties present their claims before a neutral third party, who then makes a final, often binding, decision on the matter. Commercial disputes are sometimes resolved by arbitration because procedural aspects of arbitration are different from court procedure. Construction contracts often require arbitration instead of court litigation. Arbitration has been said to be easier and less expensive than litigation, but it can be difficult and expensive for the uninitiated.
